Mmmm ... the distinction I'm surprised nobody has mentioned is between
publishers and carriers. It's been long accepted that for 99% of the
content their subscribers access, ISP's are carriers rather than publishers
- and hence not liable. For that small amount of material which originates
on their site, or is carried by their site they are publishers ... and
hence liable.
The tone of the newspaper article was that no notice is being taken of that
distinction - and I find that very worrying indeed.
