Apparently not, after all they did warn you what you should be using.

Perhaps they believe that if they use a statement like that then it
absolves them from their HREOC guideline responsibilities.

Mind you they might also respond that the site was developed as part of
their outsourcing and hence is not their problem, but that of the
outsourcer.

It would be interesting to know just how much of my/your/our taxes this
gummint has paid out to the Evil Empire in licence fees since '96
